Terms of Service

These terms govern your use of ZapTranslator. By creating an account, you agree to them.

Read clause 7 in particular, on the limits of machine translation, and clause 6, on WhatsApp's rules — both directly affect how you should use the platform.

1. What the service is

ZapTranslator connects WhatsApp numbers to a web platform where your team reads and replies, with automatic translation of messages between languages.

The service is provided by Ricardo Biruel (Infodesk Technologies), through zaptranslator.com.

2. Your account, your responsibility

You must be 18 or older and legally able to enter into a contract. If you use the service on behalf of a company, you confirm you have authority to bind it.

You are responsible for what happens in your account, including the actions of members you invite. Keep your credentials safe and tell us immediately if you suspect unauthorised access.

3. Plans, credits and payment

Text translation is unlimited on every plan. Metered features — such as transcription and voice — consume credits.

Monthly plan credits do not roll over: the plan balance resets on renewal. Credits bought separately do roll over, and are only consumed once the monthly allowance runs out.

Prices may change. Any change is announced at least 30 days in advance and takes effect from the following billing cycle. Credits already purchased are unaffected.

4. Cancellation and refunds

You may cancel at any time. The service continues until the end of the cycle already paid for; there is no penalty.

Consumers in the European Union have a 14-day right of withdrawal from the date of purchase. Credits already consumed are not refundable.

6. WhatsApp and Meta's rules

WhatsApp is a Meta Platforms service, and using it through our platform is subject to their policies — including their rules on business messaging and recipient consent.

⚠️ A number blocked by Meta is not our decision and we cannot reverse it. Bulk messaging people who never asked to be contacted is the most common cause, and the blocked number is yours, not ours.

When connecting by QR code, the number is linked through an unofficial method. It works for getting started quickly, but Meta may restrict it at any time. For sustained commercial use, we recommend the official WhatsApp Business API.

7. The limits of machine translation

⚠️ Read this clause carefully. It defines a real limit of the product.

Translation is performed by artificial intelligence models. It is good enough to hold a commercial conversation, but it is not exact, it is not reviewed by a human translator, and it has no standing as a certified translation.

Errors do occur, and are more likely with slang, niche technical terms, wordplay and figures written out in words. Verifying critical information is your responsibility — price, quantity, deadline, payment terms and any contractual clause — before treating it as agreed.

We are not liable for loss arising from an inaccurate translation. If a deal depends on the exact wording, use a human translator or confirm the figures in both languages.

8. Availability

We work to keep the service available, but we do not guarantee uninterrupted operation. There is scheduled maintenance, vendor failure and unforeseen incident.

Part of the service depends on third parties — Meta, translation providers and infrastructure vendors. Their downtime affects ZapTranslator and is outside our control.

While the product is in its early phase we do not offer an SLA — *Service Level Agreement* — with financial compensation. When we do, it will be under a specific contract.

9. Your data and your content

The content of your conversations is yours. We do not use it to train models, we do not sell it, and we do not share it beyond what delivering the service requires.

You may export your data and close your account at any time. How personal data is processed is described in our Privacy Policy, which forms part of these terms.

10. Suspension and termination

We may suspend or close an account that breaches these terms — clause 5 in particular — or that creates legal or security risk for the platform and for other customers.

Wherever possible we warn first and give an opportunity to put things right. In cases of serious abuse or legal order, suspension may be immediate.

11. Limitation of liability

To the extent permitted by applicable law, our total liability is limited to the amount you paid for the service in the 12 months preceding the event.

We are not liable for lost profits, lost business opportunity or indirect damages.

Nothing here excludes liability that the law does not permit to be excluded — including wilful misconduct, gross negligence, and the statutory rights of consumers.

12. Changes to these terms

We may amend these terms. Material changes are announced by email 30 days in advance. If you do not agree, you may cancel before they take effect.

13. Governing law and jurisdiction

These terms are governed by Portuguese law. The courts of Lisbon, Portugal, have jurisdiction.

Consumers keep the right to bring proceedings in the courts of their own domicile and to use alternative consumer dispute resolution bodies, where the law so provides.
